(collectively, “Moldex”, “we”, “our”, and “us”). Except as otherwise provided herein, these Terms of Use (“Terms”) govern your use of the Website, and any interactive features, widgets, plug-ins, applications, content, downloads, and other services available from, by, or through the Website, regardless of how you access or use them. To the extent that we provide you notice on the Website of different or additional terms of use, those additional terms shall also govern your use of the Website. In the event of any conflict between these Terms and those, these shall control.

The foregoing are not meant to be completely comprehensive, nor are they intended to be used in place of the warnings & instructions that accompany Moldex products. It is the user’s responsibility to select personal protective equipment based on worksite-specific factors, and other criteria affecting worker health and safety.   1. Applicable Law, Venue, and Jury Trial Waiver

These Terms shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any conflicts of law provision.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Website shall be venued exclusively in the federal or state courts located in Los Angeles, California, USA. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts, and hereby submit to the personal and subject matter jurisdiction of the same.

TO THE EXTENT PERMITTED BY LAW, IN THE EVENT OF ANY LAWSUIT, YOU AND WE KNOWINGLY AND VOLUNTARILY AGREE THAT A JUDGE, WITHOUT A JURY, WILL DECIDE THE CASE. YOU AND WE KNOWINGLY AND VOLUNTARILY WAIVE YOUR AND OUR RIGHT TO A TRIAL BY JURY.

  • You agree that any questions, comments, suggestions, or feedback you provide to Moldex are not confidential and you grant us a worldwide, royalty-free license to use, publish, and disseminate your submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
  1. Consumer Protection Exclusion

If you are a consumer, the provisions in these Terms are intended to be only as broad and inclusive as is permitted by the laws applicable to our relationship with you (which may be your state of residence). No provision of these Terms shall limit or waive your applicable rights, if any, as a consumer under the law applicable to our relationship with you which are not waivable, but we reserve all rights, defenses, and permissible limitations available to us under such applicable law.
