Moldex-Metric, Inc. (“Company” “we” “our” “us”) provides this Privacy Policy to explain how we collect, use, protect, and disclose information and data when you use our website at www.moldex.com regardless of the manner (desktop, mobile, etc.) in which you access it (the “Website”), and any other time you interact directly with us regarding our products, or our services (“Services”).  This Privacy Policy applies to all users of our Website and Services.  However, it does not apply to the practices of the Company’s foreign subsidiaries or foreign affiliated entities, nor the websites or webpages of such foreign subsidiaries or affiliates which can be accessed from the Website. For the avoidance of doubt, this Privacy Policy does not apply to the European region website which can be found here: https://www.moldex-europe.com/en/ and here: https://www.moldex-europe.com; such European region website has its own applicable policies, including its own privacy policy and terms of use which govern the same.

Subject to the foregoing, this Privacy Policy applies to the Personal Information (as defined below) that we process when you use this Website, our products, or our Services, and when you otherwise interact with us as described in more detail below. Except as otherwise provided herein, your use of our Website, and any related dispute over privacy, is subject to our Terms of Use. You can opt out of receiving certain e-mails by e-mailing us at marketingoptout@moldex.com.  You can also opt out of receiving marketing e-mails from us by following the link provided at the bottom of all marketing e-mails you receive from us.  However, you cannot opt out of receiving all e-mails from us, such as e-mails about the status of your account.  If you have questions or concerns regarding this Privacy Policy, please e-mail us at that same address.

We maintain commercially reasonable safeguards designed to protect the Personal Information we collect.  However, no data transmission over the Internet or other network can be guaranteed to be 100% secure.  As a result, while we strive to protect information transmitted on or through the Website or Services, we cannot and do not guarantee the security of any information you transmit on or through the Website or Services, and you do so at your own risk.

Our Website and Services may contain links to other web sites that operate independently of us. We provide links to these sites solely for your convenience and information, but these sites are not under our control and this Policy does not apply to them. These sites may have their own privacy policies, which we strongly suggest that you review prior to using the sites themselves. We are not responsible for information that is collected, used or disclosed by these sites or for any use you make of these sites.

  1. Children’s Privacy

The Website and Services are intended for users who are 13 years old or older.  We do not knowingly collect Personal Information from children under the age of 13.  If we become aware that we have inadvertently received Personal Information from a child under the age of 13, we will delete such information from our records.  If you are a parent or legal guardian and think your child under 13 has given us information, you can email us at privacy@moldex.com or use the physical address provided below.  Please mark your message “COPPA Information Request.”  Please note that most of the user content that appears on our Website or Services is stored and controlled by third party providers; thus, complete and comprehensive removal of the content may not be possible.

Please be aware that your Personal Information and communications may be transferred to and maintained on servers or databases located outside your state, province, or country.  If you are located outside of the United States, please be advised that we generally process and store Personal Information in the United States.  The laws in the United States may not be as protective of your privacy as those in your location.  By using the Website or Services, you are agreeing to the collection, use, transfer, and disclosure of your Personal Information and communications will be governed by the applicable laws in the United States.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, allows our users who are California residents to annually request and obtain, at no charge, information about the personal information (if any) we have disclosed to third parties for direct marketing purposes in the preceding calendar year. This information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which We shared information in the immediately preceding calendar year.
